Bellevier Windows – United States Limited Warranty

In adherence to the stipulations of this exclusive warranty, Bellevier Windows (“Bellevier”) affirms that all windows and doors crafted by Bellevier will be devoid of any defects that could compromise the functionality and performance of the supplied systems. This limited warranty remains valid exclusively when the systems are installed by an authorized Bellevier dealer (referred to as a “Partner”) or otherwise by a duly recognized installer acknowledged by Bellevier. Furthermore, compliance with the Bellevier Operation, Care & Maintenance Manual and adherence to all other terms and conditions outlined in this limited warranty are prerequisites for its validation.

Finishes: 

Paint and Anodizing in alignment with the provisions of this limited warranty, Bellevier warrants that aluminum components treated by Bellevier will not exhibit any detachment, flaking, blistering, discoloration, or loss of gloss beyond predefined tolerances (e.g., AAMA 2603, 2604, 2605).

Painted and anodized finishes:

  • Limited warranty of five (5) years against corrosion, unless within 3 miles of saltwater, in which case a limited warranty of three (3) year applies;
  • Pre-Ano Painted finish: Limited warranty of Fiften (15) years against corrosion.

This limited warranty encompasses the expenses for labor and materials required to repaint the affected aluminum areas on-site where the product is installed.

In instances of corrosive atmospheres, a prior arrangement must be established with Bellevier concerning the surface treatment procedure.

Insulated Glass

In line with the specifications of this limited warranty, Bellevier assures that all glass supplied by Bellevier is free from any obstructions, such as debris, distortions, discoloration, fingerprints, scratches, etc., between the glass panes. Bellevier defers to the ASTM Glass Inspection Criteria for determining acceptable ranges.

  • Defective glass: Limited warranty of ten (10) years; in case of defective glass, Bellevier will provide replacement glass for units up to 60 sqft;
  • Laminated glass: Limited warranty of three (3) years; in case of defective laminated glass, Bellevier will provide replacement glass.

Hardware and Accessories

In consonance with the terms of this limited warranty, Bellevier guarantees that hardware and accessories supplied by Bellevier will be devoid of defects in both material and workmanship.

  • Properties, functionality, and design: Limited warranty of five (5) years;
  • Wearing parts (under normal and reasonable use): Limited warranty of three (3) years.

Extent of the Warranty

This limited warranty does not encompass on-site repairs or the re-delivery of faulty products supplied by Bellevier.

Validity 

The validity of this limited warranty is contingent upon the fulfillment of the following conditions. Failure to meet any of these conditions renders all warranty rights null and void. The responsibility to provide evidence that the prerequisites of this limited warranty have been fulfilled rests with the party asserting a claim under this limited warranty.

Adherence to the recommended protective measures, with specific emphasis on systematically safeguarding aluminum structures during transport and installation, using the protective tape prescribed by Bellevier. This tape must be applied on a clean surface and removed within two (2) months from the product’s delivery;

  • Regular and competent maintenance of aluminum structures, employing non-aggressive cleaning agents as per the Bellevier Operation, Care & Maintenance Manual, and particularly following the cleaning instructions outlined below:
  • Method: Clean aluminum surfaces using lukewarm water with a non-aggressive, pH-neutral (6-8), non-acetose detergent without ammonia. After cleaning, apply Reynafinish 60 or an equivalent product to preserve color and gloss;
  • Frequency: Twice a year in non-corrosive atmospheres and rain-exposed conditions, and four times a year in all other scenarios.

The Bellevier Operation, Care & Maintenance Manual

The manual is an integral part of this agreement, and it is the Customer’s sole responsibility to obtain and adhere to this manual. For corrosive atmospheres, prior agreement with Bellevier must be established regarding the surface treatment process.

  • Corrosive atmospheres or other risk factors (e.g., proximity to the coast, industrial areas, aggressive environments, etc.) necessitate more frequent cleaning, as directed by Bellevier. Such atmospheres include constructions positioned:
  • Near the coast (<6 miles) or close to estuaries of large rivers (<3 miles); Above water bodies or high-humidity zones;
  • Within industrial zones, particularly those with substantial chemical, fluoride, gas, or ore emissions;
  • In densely urban areas with high combustion gas emissions;
    Exposed to heavy traffic (motorways, railways, airports);
  • In aggressive environments like swimming pools, water treatment facilities, laboratories, or areas prone to animal-related pollution.

Exclusions


This limited warranty is exclusively provided by Bellevier and applies solely to the benefit of the Customer to whom Bellevier expressly offers this warranty, explicitly replacing all other warranties, whether express or implied, in fact or by law, statutory or otherwise. This limited warranty does not apply under the following circumstances:

  • When the Customer fails to fulfill or punctually fulfill payment obligations;
  • Damage resulting from deliberate actions or human error;
  • Incorrect installation;
  • Damage caused by acts of nature, such as:
  • Civil war, acts of terrorism, or sabotage;
  • Uprisings, revolts, riots, strikes, lock-outs, claims;
  • Volcanic eruptions, earthquakes, floods, tidal waves, and other natural disasters;
  • Direct or indirect consequences of explosions, heat exceeding 150 degrees Fahrenheit, radioactivity, ionic radiation, hazardous or explosive nuclear fuel or waste.

All damage to surface treatments:

  • Arising from non-adherence to processing and maintenance regulations as outlined in the Bellevier Operation, Care & Maintenance Manual, wear, or normal aging;
  • Resulting from deformations of mechanical origin;
  • That do not affect the normal aesthetic appearance of aluminum structures;
  • Caused by cleaning with liquids or materials that the surface treatment cannot chemically resist.
  • Any color discrepancies noticeable BEFORE installation must be reported prior to fitting and cannot serve as grounds for element replacement;
  • Metallic colors and structured metallic colors: A warranty applies solely to adherence, excluding properties and/or visual aspects;
  • Damage occurring post-production due to non-Bellevier-handled transportation to and on-site during construction;
  • Damage resulting from continuous or abnormal immersion in water solutions, except in cases of explicit prior consent by Bellevier (provided in writing).
  • Damage resulting from contact with materials such as certain metals (copper, lead, etc.) causing galvanic coupling, timbers (oak, walnut, etc.) secreting acids corroding metal, and lime or cement, which are highly alkaline and can permanently damage surfaces;
  • Screen mesh damage;
  • Claims for compensation of special, indirect, punitive, consequential, incidental damages, or any other non-out-of-pocket direct damages (including loss of enjoyment, unemployment, immobilization, depreciation);
  • Delays in repair execution or possible preventative touch-ups resulting from inspections, controls, or tests;
  • Direct or indirect damage arising from cracks, bursts, or corrosion in aluminum structures that were deformed or bent after paint or anodizing application;
  • When third parties perform work on aluminum structures without explicit prior approval from Bellevier (expressed in writing);
  • When specific regulations concerning painting or anodization processes and maintenance, applicable to aluminum products located in unique atmospheres (coastal areas, industrial settings, aggressive environments, pools, etc.), are not adhered to;
  • In case of any alteration or interference with the product by the Customer, no warranty is offered concerning corrosion or filiform corrosion;
  • The system warranty becomes invalid when non-Bellevier components are used or non-Bellevier modifications are made (unless approved by Bellevier in writing).
  • Damage such as glass cracks, runs, spontaneous breakage, or surface damage, rattling of grids between glass panes, normal tempering distortion, failure resulting from high-moisture area installations, failure to order necessary breather tubes or close them properly, application of film to glass, butt-joined glass, uniform finish fading, finish crazing at joints on lighter anodizing shades.

Important Notes

Products must be correctly installed and maintained. Systems must be installed by an authorized Bellevier dealer or a recognized installer approved by Bellevier, following Bellevier’s catalogs and instructions. Regular maintenance of systems using non-aggressive cleaning agents, in accordance with the Bellevier Operation, Care & Maintenance Manual, is imperative. Corrosive atmospheres or other risk factors (e.g., limited rain) require more frequent cleaning. Detailed instructions on correctly maintaining Bellevier systems can be found in the Bellevier Operation, Care & Maintenance Manual *. Failure to meet these requirements renders this limited warranty void. The responsibility of proving compliance with these requirements rests with the party making a claim under this guarantee.

Initiating Claims

The warranty period under this limited warranty commences on the day the product leaves the factory, as defined by Bellevier. When making a claim, a Bellevier Invoice number is mandatory for validation. This limited warranty is exclusively valid for the Customer to whom the products were sold and is not transferable. Decisions regarding replacement or repair of products covered by this limited warranty will be at the sole discretion of Bellevier.

Any disputes arising from or related to this limited warranty will be resolved in the courts of Maricopa County, State of Arizona. These courts will serve as the exclusive forum for any such dispute between the Customer and Bellevier. Claims made under the provisions of this limited warranty must be submitted in writing to the following address:

THIS LIMITED WARRANTY REPLACES ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE. THIS LIMITED WARRANTY DOES NOT COVER, AND BELLEVIER SHALL NOT BE LIABLE FOR, SPECIAL, INDIRECT, PUNITIVE, CONSEQUENTIAL, INCIDENTAL DAMAGES, OR ANY OTHER DIRECT DAMAGES NOT PAID FROM POCKET, ARISING FROM CONTRACT, TORT, OR OTHERWISE. BELLEVIER’S LIABILITY WILL ALWAYS BE LIMITED TO THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT.

This limited warranty is solely applicable within the U.S.A.

This limited warranty grants specific legal rights and may confer additional rights that vary from state to state. Some states may not allow the exclusion or limitation of specific damages, thus the contents herein do not contradict applicable law. This limited warranty provides the Customer with distinct legal rights, and these rights may also vary from state to state.
